Terms of Service

Welcome to Campus Rentals. By accessing or using our platform, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

1. Acceptance of Terms

By using Campus Rentals (the "Platform"), you agree to these Terms, our Privacy Policy, and all applicable laws and regulations. If you do not agree, do not use the Platform.

2. Platform Description

Campus Rentals is a property listing platform that connects property owners ("Owners") with prospective tenants ("Tenants"). We facilitate the application process but are not party to any rental agreements between Owners and Tenants.

3. User Accounts

3.1 Property Owners

• Must provide accurate information when creating an account
• Responsible for maintaining the security of their account
• Must comply with the Property Owner Agreement
• Agree to pay platform commission (16% of first year's rent) for tenants found through the platform

3.2 Tenants

• Must provide truthful information in rental applications
• Must not misrepresent financial status, employment, or references
• Understand that applications are submitted to property owners through the platform

4. Platform Commission

Property Owners agree to pay Campus Rentals a one-time success fee of 12% of the first year's gross rent for any tenant sourced through the Platform. This applies for 12 months from initial application date.

No upfront costs. Pay only when we successfully place a tenant. If we don't find you a tenant, you pay $0. Example: For a property renting at $1,200/month ($14,400/year), the success fee would be $1,728, payable upon lease signing.

5. Prohibited Conduct

Users may not:

• Use the Platform for fraudulent or illegal purposes
• Circumvent the Platform to avoid commission payments
• Harass, threaten, or discriminate against other users
• Post false, misleading, or discriminatory listings
• Scrape, copy, or misuse Platform content without permission
• Violate fair housing laws or regulations

6. Property Listings

6.1 Owner Responsibilities

• Ensure listings are accurate and up-to-date
• Update availability promptly
• Respond to qualified applications within 48 hours
• Comply with all fair housing laws

6.2 Platform Rights

We reserve the right to remove listings that violate these Terms, are fraudulent, or otherwise inappropriate.

7. Applications & Communication

All initial communications between Owners and Tenants must go through the Platform to maintain tracking and ensure commission compliance. Direct circumvention violates these Terms.

8. Fair Housing Compliance

All users must comply with federal, state, and local fair housing laws. Discrimination based on race, color, religion, sex, national origin, familial status, or disability is prohibited and will result in immediate account termination.

9. Privacy & Data

Your use of the Platform is subject to our Privacy Policy. We collect and process data as described therein.

10. Disclaimers

10.1 No Warranty

THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THE ACCURACY OF LISTINGS, THE CONDUCT OF USERS, OR THE SUCCESS OF ANY RENTAL TRANSACTION.

10.2 No Landlord-Tenant Relationship

Campus Rentals is not a party to any rental agreement. We do not own, manage, or control any properties. All rental agreements are between Owner and Tenant.

10.3 Screening

We do not perform background checks, credit checks, or verify user information. Owners are responsible for their own screening processes.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAMPUS RENTALS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE FEES PAID BY YOU IN THE PAST 12 MONTHS, OR $100, WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify and hold harmless Campus Rentals from any claims, damages, or expenses arising from your use of the Platform, violation of these Terms, or violation of any rights of another party.

13. Intellectual Property

All Platform content, including text, graphics, logos, and software, is owned by Campus Rentals and protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works without permission.

14. Termination

We may terminate or suspend your account at any time for violation of these Terms. Upon termination:

• Your access to the Platform will cease immediately
• Outstanding commission obligations remain enforceable
• Sections 4, 10, 11, 12, and 15 survive termination

15. Dispute Resolution

15.1 Negotiation

Parties agree to first attempt to resolve disputes through good faith negotiation.

15.2 Arbitration

If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules.

15.3 Class Action Waiver

You agree to resolve disputes individually and waive any right to participate in class actions.

16. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

17. Changes to Terms

We may modify these Terms at any time. Material changes will be notified via email or Platform notice. Continued use after changes constitutes acceptance.

19. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full effect.

20. Entire Agreement

These Terms, together with the Privacy Policy and Property Owner Agreement, constitute the entire agreement between you and Campus Rentals.
